GENERAL TERMS AND CONDITIONS FOR EXHIBITORS AT MEDIACCESS AG EVENTS
1. ACKNOWLEDGEMENT OF THE TERMS AND CONDITIONS
The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy.
It is generally possible to use our website without providing personal data. If personal data (e.g. name, address or e-mail addresses) is collected on our website, this is always done on a voluntary basis as far as possible. This data will not be passed on to third parties without your express consent (acceptance of the terms and conditions).
We would like to point out that data transmission over the Internet (e.g. when communicating by e-mail) may be subject to security vulnerabilities. Complete protection of data against access by third parties is not possible.
2. INSURANCE
It is mandatory for all exhibitors to insure all exhibition goods and stand equipment against damage and loss during an exhibition and during transportation to and from the exhibition, and to take out liability insurance. The exhibitor himself is responsible for the insurance and for determining the appropriate amount of insurance cover.
3. HAND SALES
MediAccess AG permits hand sales at the exhibition within the usual framework. The sale and simultaneous delivery of goods at the exhibition itself is deemed to be hand selling.
4. ACCEPTANCE OF THE STAND SPACE
MediAccess AG provides stand space. MediAccess AG decides on the placement of the stand space. Repositioning is possible after consultation with MediAccess AG. The stand space must be returned in good condition. MediAccess AG will organize the disposal of normal waste (small packaging, paper, etc.). Larger quantities, bulky waste and special waste will be disposed of in containers and special containers against payment of an invoice. Waste must be disposed of separately and sorted into plastic, glass, paper and residual waste.
5. SALES BEHAVIOR
Intrusive sales behavior is prohibited. Placement of stand material (tables, chairs, counters, bar stools, etc.) or advertising material outside the boundaries of the stand is permitted after consultation with MediAccess AG. Collegial behavior is expected.
6. LIABILITY/DAMAGE REPORT
Damage must be reported to MediAccess AG immediately. MediAccess AG excludes any liability for itself and its vicarious agents for slight negligence and indirect damage, in particular loss of profit, to the extent permitted by law. MediAccess AG does not act as a custodian within the meaning of Article 472 of the Swiss Code of Obligations and assumes no duty of care towards exhibitors, owners or third parties for exhibition goods, stand equipment and other third-party items. MediAccess AG excludes any liability or recourse claims in the event of damage, loss, theft or official confiscation of exhibition goods, stand fittings and other third-party items, both for the time during which the goods are on the exhibition site and during transportation to and from the site. The exhibition will not be guarded. MediAccess AG excludes all liability towards exhibitors and third parties for damage resulting from performances and presentations, from the assembly or dismantling of stands and exhibits or from stand operations. MediAccess AG is not liable to exhibitors for their commercial success at an exhibition or for any consequences arising from the location or surroundings of their stand space.
7. TERMS OF PAYMENT
With a few exceptions, the services of MediAccess AG are subject to Swiss value-added tax. Services to exhibitors domiciled outside Switzerland are also subject to VAT because the place of performance (Switzerland) is decisive.
After confirmation of the contract by MediAccess AG, the exhibitor will receive an invoice on account for the cost of the stand space and for an advance payment for additional services to be provided. All invoices are due for payment net and without discount within the specified deadlines. Payments by check are not accepted.
If an invoice on account is not paid within the specified period, MediAccess AG reserves the right to terminate the exhibitor contract with immediate effect after setting a written deadline of 8 days and to dispose of the stand space concerned elsewhere. In this case, the defaulting exhibitor must pay compensation amounting to 75% of the cost of the stand space, but at least CHF 2,000, or the full amount if the cost of the stand space is less than CHF 2,000. The corresponding invoice is due for payment within 14 days of the invoice date. MediAccess AG must be in possession of the payment or a legally valid proof of payment by the start of the official stand allocation date at the latest, otherwise MediAccess AG is authorized to refuse the exhibitor access to the premises (exhibition) or to clear the stand immediately at the exhibitor’s expense.
The exhibitor will be sent the final invoice for additional services provided after the event, whereby the advance payments already made will be offset against the actual expenses. The final invoice must be paid net and without discount within 30 days of the invoice date. Complaints must be notified to MediAccess AG in writing and with reasons within 10 days of receipt of the final invoice, otherwise the final invoice shall be deemed to have been accepted.
8. CANCELLATION OR TERMINATION
Cancellation of participation in an exhibition by the exhibitor must be made at least 4 months before the start of the event and notified in writing (e.g. e-mail), otherwise the agreed fee remains payable in full. Cancellation must be reconfirmed in writing by MediAccess AG, otherwise it is invalid. Any additional costs incurred as a result of a cancellation must be borne in full by the exhibitor. MediAccess AG is entitled to cancel or prematurely terminate an event before it takes place. If an event has to be canceled or prematurely terminated for reasons for which MediAccess AG is not responsible, or due to force majeure, MediAccess AG shall be released from its performance obligations and exhibitors shall have no claim against MediAccess AG for performance, withdrawal from the contract or compensation. Payments already made will not be refunded.
9. EXCLUSION
Exhibitors who violate statutory provisions or obligations arising from the exhibitor contract, who fail to comply with the instructions of MediAccess AG, or whose behavior at the exhibition gives rise to justified complaints on the part of participants or exhibitors, may be excluded from the exhibition by MediAccess AG with immediate effect. In the event of exclusion from the exhibition, MediAccess AG is entitled to close the exhibitor’s stand immediately and to demand that the stand be dismantled and the stand area vacated without delay. If the exhibitor defaults on this, MediAccess AG is entitled to dismantle the stand and/or clear the stand area at the exhibitor’s expense. The excluded exhibitor is liable for the full cost of the stand area and the ancillary costs incurred. The exhibitor shall not be entitled to claim damages.
10. APPLICABLE LAW AND PLACE OF JURISDICTION
Swiss law shall apply exclusively. In the event of disputes, exhibitors submit to the jurisdiction of the ordinary courts of the Canton of Zurich. MediAccess AG may also choose to assert its claims against an exhibitor in the court of the place where the exhibitor has its place of residence or registered office.
